Terms of Use of the Site: Purchasing Services and Receiving Information

• Various actions may be performed on the site solely for placing orders, receiving services and/or information. This site may not be used for other purposes.
• Any person over the age of 18 who holds a valid credit card of one of the credit card companies active in Israel (or who has explicit authorization from the credit card holder) may submit offers to purchase services through the site.
• The purchaser’s order or offer (hereinafter: “Offer”) to receive services will be accepted,
provided that all of the following conditions are met:
1. Approval for the transaction has been given by the purchaser’s credit card company.
2. The requested products are in stock.
3. The address at which the service is to be provided is within the Business’s delivery map.
4. The purchaser has a personal email address on the internet, unless the transaction is made by telephone.
5. The day on which the bouquet is to be delivered is not a Saturday or an Israeli holiday.

How to Submit Offers to Purchase Services Through the Site

• For a detailed and full description of the process of submitting offers to purchase services through the site, please see How to Buy. What is stated in How to Buy is an integral part of these Terms, and reading it is a condition for submitting an offer to purchase services from the Business.
Services and Prices Policy
• Orders on the site will be accepted only for purchases over ₪150.
• The photos on the site are of bouquets in several sizes and represent the medium bouquet.
• The range of services, the prices (including shipping costs) and the payment terms on this site may change from time to time at the sole discretion of the Business.
• In the event that an order was placed to purchase flower bouquets and flower arrangements displayed on the site and it turned out that any of the products is out of stock, the Business will supply the purchaser with a product similar to the product ordered, as far as possible in the colors and/or type of products ordered in the original order.
• And in the event that any other product displayed on the site is out of stock, an appropriate notice will be sent to the purchaser by email or by telephone. The Business reserves the right to offer the purchase of an alternative product of a similar nature and price. If the purchaser agrees, the details of the order will be updated accordingly. If not, the order will be deleted, and the purchaser’s credit card will not be charged.

When the customer has purchased from the site and one of the flowers is unavailable or out of stock, the designer will replace that flower with another flower without harming the integrity of the bouquet. If more than one flower is out of stock, the customer will be contacted and informed of the shortage of the flowers in stock, and will be offered another alternative for the delivery. If the customer does not answer the phone within a reasonable time, the site manager will send, in place of the missing product, a product as similar as possible to the product chosen, at the same price.
In the event that one flower is out of stock, the Business will replace the flower with another, similar flower that will not harm the character of the bouquet, at the discretion of the florist.
If the customer does not agree to receive another alternative product, the transaction will not be carried out, and accordingly the customer’s credit card will not be charged.
• Details of the Purchaser of Services and Site Security
• When placing an order to purchase services through the site, the purchaser will be required to enter into the system personal details, order details, credit card details, etc. (hereinafter: “the Details”). The owners of the site and/or any of its operators and/or any of its managers and/or anyone on their behalf are not responsible for an error made by the purchaser when typing the Details. Likewise, the above will not bear any liability whatsoever, directly or indirectly, for a case in which the purchase details are not received by the system and/or for any technical and/or other problem preventing actions on the site.
• Typing false details is a criminal offense. Legal action will be taken against those who provide false details, including tort claims for damages that may be caused to the site and/or to the owners of the site and/or to any of its operators and/or to any of its managers and/or to anyone on their behalf. In the event of incorrect typing of details (including the purchaser’s personal details), the Business and/or anyone on its behalf reserves the right to disqualify the Offer.
• The Business’s data processing computer keeps a computerized record of all actions performed on the site. This record will constitute prima facie evidence of what is stated in these actions. However, the server clock will constitute final and conclusive evidence regarding the time at which an action was performed on the site.
• The details of the action on the site, including the details of the Offer and the details of the purchaser, will be transferred through an encrypted security protocol (SSL), which is standard in e-commerce, to the Business’s data processing computer. These details will not be transferred by the Business and the site operators to external parties, except to the credit card company and to suppliers, and only in order to complete the purchase actions performed by the purchaser. The Business reserves the right to use the details provided by the purchaser for statistical analysis and for future marketing use. In this case, the data will not refer personally to the person performing the action and will not identify them.
• The Business may send those performing actions email and contact them in writing or orally with any information about the Business’s promotions, new features on the site, advertisements from selected commercial entities and the like, unless the purchaser notifies in writing that they are not interested in this.
• The site has a minimum order of ₪150

• All prices displayed on the site include VAT, unless explicitly stated otherwise. Payment for the services will be collected through the credit card whose details were typed into the Offer, before or close to the dispatch of the products to the address stated in the Offer. If, according to the Business’s policy, payment in installments is possible, the charge will be made accordingly (subject to the approval of the credit card company).
• The total amount the purchaser will be charged appears “on the transaction details screen, in the checkout process”. This amount includes all the items appearing in the “cart”, including shipping costs.
• Provided that full payment for the product has been made, the shop will act to ensure that the delivery of the product reaches the requested destination in accordance with the delivery hours, between 3 and 5 hours from the moment the order is approved (according to the delivery areas, provided it was placed during the order center’s hours of operation: Sunday to Thursday 8:30 to 19:00, Fridays and holiday eves 7:00 to 16:00, except on holiday eves and Fridays, when it will not be possible to commit to an arrival time). On these days the order will be supplied during the day. The delivery range for deliveries is from 9:00 until 20:00; an order placed by 9:00 will reach its destination by 16:00, or by the start of Shabbat on Fridays.

For a delivery placed from 16:00 onward for the same day, the customer must confirm with the Business that the delivery was received in the system
A delivery that returned to the branch will require the customer to pay an additional delivery fee in order to send the order out again to the original destination or to another destination

Cancellation of Actions by the Purchaser
• Any purchaser who submitted an offer to purchase flowers, plants, ornamental plants, flower bouquets and flower arrangements, and who wishes to cancel their offer, shall give notice of this within one hour of the time they sent their offer to the shop (or of the time of the telephone contact with the shop), and provided that the product is not ready. If the order is to be carried out on another day, notice of cancellation may be given up to one day before the date the order is to be carried out, during the order center’s hours of operation (Sunday to Thursday 8:00-19:00, Friday and holiday eves 8:30-16:00). The notice of cancellation will be given to the Business’s telephone center by phone to the national order center. Cancellation of the action will be possible as long as the products have not yet been dispatched by the Business and/or anyone on its behalf to the address provided in the Offer. Cancellation of the purchase of any other product (that is not perishable as stated) will be made within 14 days of the day the product was received, provided the product has not been used and is in its original packaging as delivered to the purchaser.

Limitation of Liability

• The Business strives for all the products it offers on the site to be of high quality and fit for use. Great emphasis is placed on the high quality of flowers, plants, ornamental plants, flower bouquets and flower arrangements.
• The Business undertakes that flowers, plants, ornamental plants, flower bouquets and flower arrangements will be of good quality and fresh. If any of the products mentioned above is not fresh, the purchaser is entitled to contact the Business (through our telephone center, phone: 09-8986741) and report it.
• The parties agree that the Business will examine the complaint and may replace the defective product or credit the purchaser with the amount paid or a partial amount of the amount stated for that product (including the cost of delivery, if no other services were ordered by the purchaser in the same transaction), at its sole discretion.
• Sole responsibility for all products that are not flowers, plants, ornamental plants, flower bouquets and flower arrangements, and for any information or representation made on the site regarding the nature of the products, including the names of the manufacturers, the quality of the products, the properties of the products, the photos of the products and the like, lies with the manufacturers and/or importers and/or authorized distributors of the products, in accordance with the consumer protection laws and regulations and in accordance with the terms of the warranty and service certificates attached to each product/service, if attached.
• The photos on the site are for illustration only. It is emphasized that because the photos are displayed on a computer screen and/or printed by the computer, there may be differences and changes between the appearance of the product in the photo and the product in reality.
• In any case, the liability of the Business, under any legal cause whatsoever, for the products mentioned in this section will not exceed the amount actually paid for the product/service ordered by the purchaser.
• The Business and/or the owners of the site and/or its founders and/or any of its operators and/or any of its managers and/or anyone on their behalf are not responsible for the server through which the site operates being free of viruses or other foreign components or elements that may harm or damage the purchaser’s personal computer or other equipment of the purchaser when they enter and/or order services and/or use the site. Likewise, the Business will not bear responsibility for illegal activity on the site carried out by any purchaser or any third party not under the control of the Business. The Business may stop or prevent the engagement or access of purchasers to any part of the site or to the entire site at any stage.
Indemnification and Compensation for Improper Use of the Site
• Anyone who makes improper use of the site undertakes to indemnify and compensate the Business and/or the owners of the site and/or its founders and/or any of its operators and/or any of its managers and/or anyone on their behalf for any claim and/or expense and/or damages of any kind whatsoever, including legal expenses, that will be caused to the Business and/or the owners of the site and/or its founders and/or any of its operators and/or any of its managers and/or anyone on their behalf.

Ownership and Protection of Rights

• The site contains various materials protected by copyright, trademarks and other proprietary rights, including content, photos, graphics, music, video and sound, some of which are owned by the Business and some by third parties. A purchaser and/or visitor and/or any third party performing actions on it may not change, publish, broadcast or transmit, take part in transferring or selling, or use the site or any part of it to create a derivative work, or exploit the site and/or its content, in whole or in part, for any purpose, except the purpose for which the site was created. The Business permits the user to “download” data to their personal computer for personal, non-commercial use only; this permission, like any other legal action on the site, does not grant the user any proprietary right in the said information in particular, or in the site and its content in general.
• The user undertakes not to “upload” to the site any information of any kind whatsoever that infringes copyright, trademarks and/or any other proprietary right, and/or pornographic material and/or material that may be defamatory, etc. If the user uploaded information and/or material as stated above, they undertake to indemnify the Business and/or anyone on its behalf and/or the site operators for any damage and/or expense (including attorney’s fees and legal costs) caused to them as a result of the user’s improper conduct mentioned above.
• The site contains links to other sites on the internet. The Business provides these links for convenience only and bears no responsibility for the information appearing in them or in other sites linked to them, for their validity or their legality. A purchaser who wishes to use these links does so at their own responsibility only.
• Anyone who wishes to create a link to this site on other sites is required to contact the Business in writing and in advance in order to receive written approval for this. Additional terms and jurisdiction.
• The Business may close the site or cancel or reduce services. Likewise, the Business may change the site’s terms from time to time.
• Any dispute whatsoever between a purchaser and/or visitor to the site and the Business due to activity through the site will be heard in Israel, in any of the courts throughout the country.
